Examining Groups
The decisions of the examining boards of the KJM as a whole are prepared by examining groups set up by the KJM chairman in accordance with the KJM rules of procedure. The examining groups deal with all factual and legal issues of a case and draw up recommendations for the decisions to be taken. The groups consist of five members from the media authorities, the supreme state youth authorities in charge of the protection of minors, the Federal Department for Media Harmful to Young Persons (BPjM), jugendschutz.net and the Bundeszentrale für politische Bildung (bpb). They are each appointed in a transparent and objective selection process.
Meetings or decision-taking processes made in writing
The examining groups develop their recommendations for decisions on the basis of the documentation of the content in question which is provided by the media authority in charge of the provider or by jugendschutz.net (e.g. recording of a broadcast, print-out or data media) together with a first analysis of the issue concerned. The examining group deals with the issue in a meeting; recommendations concerning applications for exceptions in line with Art. 9 (1) JMStV are as a rule arrived at in a process in which positions are exchanged in writing. The KJM chairman then forwards the recommendations of the examining group to the examining boards with a deadline. The examining board adopts the recommendation given by the examining group once as each member has expressly accepted it. If members deviate from a recommendation, they have to give their reasons for dissenting.
